City of Ute ORDINANCE 230 AN ORDINANCE ADDING TO THE UTE MUNICIPAL CODE, 2017, TITLE II – POLICY AND ADMINISTRATION CHAPTER 10 – PARK REGULATIONS BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF UTE, IOWA: SECTION 1. Title II – Policy and Administration, Chapter 10 PARK REGULATIONS is hereby added and adopted: TITLE II – Policy and Administration CHAPTER 10 PARK REGULATIONS 2-10-1 Purpose 2-10-2 Use of Drives Required 2-10-3 Fires 2-10-4 Littering 2-10-5 Park Hours 2-10-6 Code of Conduct 2-10-7 Shelter House Rentals 2-10-41 PURPOSE. The purpose of this chapter is to facilitate the enjoyment of park facilities by the general public by establishing rules and regulations governing the use of park facilities. (Code of Iowa, Sec. 364.12) 2-10-2 USE OF DRIVES REQUIRED. No person shall drive any car, motorcycle or other vehicle, or ride or lead any horse, in any portion of a park except upon the established drives or roadways therein or such other places as may be officially designated by the City. Special exceptions may be granted by the Public Works Superintendent. 2-10-3 FIRES. No fires shall be built, except in a place provided therefor, and such fire shall be extinguished before leaving the area. 2-10-4 LITTERING. No person shall place, deposit, or throw any waste, refuse, litter or foreign substance in any area or receptacle except those provided for that purpose. 2-10-5 PARK HOURS. No person shall enter or remain within the City Park between the hours of ten o’clock (10:00) p.m. and six o’clock (6:00) a.m. Reservations of the Park Shelter House are not subject to park hours. 2-10-6 CODE OF CONDUCT. The Park Code of Conduct is to be set by Resolution of the City Council. 2-10-7 SHELTER HOUSE RENTALS. Park Rental fees, deposits, and rules are to be set by Resolution of the City Council. SECTION 2. SEVERABILITY CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. SECTION 3. WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.
